You must ask if there are any principal owners and if so, you must ask them the race, sex, and ethnicity questions, but only about principals who under 10171 are defined as persons owning 25% or more of the business. You can’t ask any other owners those questions. The status of the business as Minority-, Women-, or LGBTQ+ - owned would be determined by the response of the applicant to a question that is separate from the Protected Demographic Information pertaining to the principals of the business, if any, as defined in 1071.
